Please read these Terms and Conditions carefully before using the LuxVibes platform. By accessing or using our services, you agree to be bound by these Terms, which are governed by South African law.
By accessing or using the LuxVibes platform ("Platform"), website, or mobile application, you ("User", "Rider", "Chauffeur", or "Fleet Partner") agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, you may not use the LuxVibes platform. These Terms constitute a legally binding agreement between you and LuxVibes (Pty) Ltd ("LuxVibes", "we", "us", or "our"), a company registered and operating in South Africa. We reserve the right to amend these Terms at any time. Continued use of the Platform after any changes constitutes your acceptance of the revised Terms.
LuxVibes is a premium on-demand chauffeur platform that connects riders with professional chauffeurs and fleet partners across Johannesburg, South Africa. Our platform enables riders to: • Book on-demand or scheduled premium chauffeur rides • Select from a range of luxury vehicle tiers • Add ride extras (e.g. airport meet-and-greet, privacy screen, refreshments) • Track their chauffeur in real time • Pay securely via Paystack LuxVibes acts as a technology intermediary. Rides are fulfilled by independent chauffeurs or registered fleet partners. LuxVibes does not employ chauffeurs and is not a transport operator.
To use LuxVibes, you must register an account using a valid email address. You are responsible for: • Providing accurate and up-to-date registration information • Maintaining the security and confidentiality of your account credentials • All activities that occur under your account • Notifying us immediately of any unauthorised use of your account You must be at least 18 years of age to register and use the LuxVibes platform. LuxVibes reserves the right to verify your identity and suspend accounts that provide false or misleading information.
4.1 Bookings Ride bookings are confirmed once accepted by a chauffeur or processed through the dispatch system. You will receive a booking confirmation via the Platform. 4.2 Cancellations Riders may cancel a booking at any time prior to the chauffeur departing for the pickup location. Cancellations made after a chauffeur has been dispatched may be subject to a cancellation fee. 4.3 No-shows If a rider is not present at the agreed pickup location within a reasonable waiting period, the chauffeur may cancel the ride and a no-show fee may apply. 4.4 Chauffeur Cancellations In the unlikely event that a chauffeur cancels a confirmed booking, LuxVibes will make reasonable efforts to assign an alternative chauffeur or facilitate a full refund.
5.1 Pricing Fares are calculated based on the vehicle tier selected, distance, time, and any extras chosen. All fares are displayed in South African Rand (ZAR) inclusive of VAT (where applicable). 5.2 Payment Processing All payments are processed securely through Paystack, a PCI DSS-compliant payment gateway. By completing a payment, you agree to Paystack's terms and conditions. 5.3 Revenue Split LuxVibes retains 28% of the ride fare as a platform fee. 72% is paid to the chauffeur or fleet partner. 5.4 Refunds Refund requests are evaluated on a case-by-case basis. Refunds, where approved, will be processed within 5–10 business days. 5.5 Disputes For payment disputes, contact us at matebogo@innovateiq.africa within 7 days of the transaction.
As a rider, you agree to: • Treat all LuxVibes chauffeurs with courtesy and respect • Not engage in any abusive, threatening, or discriminatory behaviour • Not damage or misuse the chauffeur's vehicle • Comply with all traffic and safety laws while in the vehicle • Not request the chauffeur to violate any traffic laws • Provide accurate pickup and drop-off information LuxVibes reserves the right to suspend or permanently ban any rider who violates these conduct standards.
All chauffeurs and fleet partners operating on the LuxVibes platform must: • Hold a valid Professional Driving Permit (PDP) at all times • Maintain a valid driver's licence and roadworthy vehicle • Maintain adequate vehicle insurance • Present a professional appearance and demeanour at all times • Adhere to the LuxVibes service standards and code of conduct • Not engage in any discriminatory, unsafe, or unprofessional behaviour toward riders • Comply with all applicable South African transport regulations LuxVibes reserves the right to deactivate any chauffeur or fleet partner from the platform for non-compliance.
To the maximum extent permitted by applicable South African law: • LuxVibes is not liable for any indirect, incidental, special, or consequential damages arising from your use of the Platform • LuxVibes does not warrant that the Platform will be uninterrupted, error-free, or completely secure • LuxVibes is not responsible for the conduct, actions, or omissions of chauffeurs, fleet partners, or riders • LuxVibes's total liability for any claim arising from these Terms shall not exceed the amount paid by you for the specific ride giving rise to the claim Nothing in these Terms limits liability for death, personal injury caused by negligence, or any liability that cannot be excluded under South African law.
All intellectual property on the LuxVibes Platform, including but not limited to the brand name, logo, design, software, content, and technology, is owned by or licensed to LuxVibes (Pty) Ltd. You may not copy, reproduce, modify, distribute, or create derivative works of any LuxVibes intellectual property without our prior written consent. Unauthorised use of our intellectual property may result in legal action.
LuxVibes reserves the right to suspend or terminate your access to the Platform at any time, with or without notice, if: • You breach any of these Terms • Your account is used fraudulently or for unlawful purposes • You engage in conduct that is harmful to LuxVibes, our chauffeurs, or other users • We are required to do so by law or regulatory authority Upon termination, your right to use the Platform ceases immediately. Provisions of these Terms that by their nature should survive termination (including payment obligations, intellectual property rights, and limitation of liability) will continue to apply.
Your use of the LuxVibes Platform is subject to our Privacy Policy, which is incorporated into these Terms by reference. LuxVibes processes personal information in accordance with the Protection of Personal Information Act 4 of 2013 (POPIA). Our Privacy Policy is available at /privacy within the Platform.
These Terms and Conditions are governed by and construed in accordance with the laws of the Republic of South Africa. Any dispute arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of South Africa, with primary jurisdiction vested in the courts of Gauteng (Johannesburg). LuxVibes encourages users to attempt to resolve any dispute amicably by contacting us at matebogo@innovateiq.africa before initiating formal legal proceedings.
